Covenants & Restrictions

You should know before reading this document that the current Covenants and Restrictions are woefully outdated. Unfortunately these guidelines were written back in 1979 when we were still recovering from the decade of love, Vietnam and feeling we needed more control. Prime examples:

  1. The assoiation can no longer just sue for any alleged violation without going through mediation first. Florida 720.311 demands pre-suit mediation.
  2. The association cannot enforce architecural guidelines without having a written set of guidelines with which to note violation. Florida 720.3035. The passage of this statute has made the terms "we can reject for any reason" obsolete.

Please be aware that the association is working to update the documents. They are also looking for volunteers and your opinion. Remember, it is easier to be part of the solution than the problem.
